Punitive Damages Possible in Deepwater Horizon Spill Case
This short article discusses Judge Barbier's recent ruling that punitive damages may be sought for certain claims in the Deepwater Horizon economic damages litigation. He also dismissed some state law claims that were preempted by federal maritime law. These and other issues will be discussed at the ABA's mid-year meeting in New Orleans where the Tort, Trial and Insurance Law Section's Task Force on Disaster Preparedness and Response will put on a program focused on disasters caused by negligence.
